User Agreement

Introduction

Welcome to Owego (“we”, “our”, “us”). Owego is a seamless payments platform powered by stablecoins that enables users to send, receive, and spend digital assets like USDC and USDT safely, instantly, and across borders. This User Agreement (“Agreement”) governs your access to and use of Owego’s website, app, and related services (collectively, “Services”).

By creating an account or using Owego, you agree to these terms. Please read them carefully before using the platform.

Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement, our Privacy Policy, and any other policies referenced herein.
If you do not agree, you must discontinue use immediately.

Eligibility

To use Owego, you must:

Be at least 18 years old and legally capable of entering into contracts;
Use the Services for lawful purposes only;
Not be subject to any sanctions or restrictions that prohibit participation in digital-asset transactions.

We may require you to verify your identity in line with Know-Your-Customer (KYC) and Anti-Money Laundering (AML) laws.

Account Registration

You must create an account to access most of Owego’s features. You agree to:

Provide accurate, complete, and current information;
Maintain the security of your login credentials;
Promptly update any information that changes;
Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate this Agreement.

Use of Services

Owego enables you to:

Deposit and hold supported stablecoins (e.g., USDC, USDT);
Send or receive payments to and from other users;
Pay online, in-store, or across borders using stablecoins;
Withdraw or convert balances where applicable.

You agree not to use the Services for:

Money laundering, fraud, or other illegal activities;
Funding terrorism or prohibited transactions;
Disrupting network operations or attempting unauthorized access.

We may monitor, suspend, or block any transaction that violates applicable law or our policies.

Fees and Charges

Transaction fees may apply depending on your payment type, network, or currency. All fees are displayed before you confirm a transaction. By proceeding, you agree to the applicable charges.

Wallets and Funds

Your Owego wallet represents your balance of supported stablecoins. You acknowledge that:

Balances are not traditional bank deposits and are not insured by any government deposit-insurance scheme;
Owego partners with regulated custodians and blockchain networks for fund storage and settlement;
Transaction times depend on network conditions and may vary.

Risk Disclosure

Digital-asset transactions involve risk, including:

Volatility in asset values;
Network delays or smart contract vulnerabilities;
Regulatory changes that may affect access to services.
By using Owego, you accept full responsibility for these risks.

Compliance and Reporting

We comply with applicable financial-services, KYC/AML, and data-protection laws. By creating an account or using Owego’s services, you expressly consent to the collection, verification, and processing of your personal and financial information for purposes of Know Your Customer (KYC) and Anti-Money Laundering (AML) compliance. You acknowledge and agree that:

Owego may collect, verify, and retain copies of identification documents, addresses, and related personal information in accordance with applicable laws and regulatory requirements.
Owego may conduct ongoing transaction monitoring, risk assessments, and enhanced due diligence where required to detect and prevent fraud, money laundering, and terrorist financing.
Your personal data may be shared with verified third-party service providers, regulators, or law enforcement agencies as required for these compliance purposes.
Refusal to provide requested information or documentation may result in the suspension or termination of your access to the platform.

We may:

Request additional verification information;
Freeze or report suspicious transactions to authorities;
Refuse service to users or jurisdictions where prohibited.

By using our services, you explicitly consent to this processing and acknowledge that such actions are necessary for regulatory compliance and the lawful operation of Owego’s services.

Intellectual Property

All content, trademarks, logos, and technology on the platform are owned by Owego or its licensors. You may not reproduce, modify, or distribute any part of our Services without prior written consent.

Limitations of Liability

To the maximum extent permitted by law:

Owego is not liable for indirect, incidental, or consequential losses arising from your use of the Services;
We do not guarantee uninterrupted access or that our Services will be error-free;
Your sole remedy for dissatisfaction is to stop using the platform.

Indemnification

You agree to indemnify and hold harmless Owego, its affiliates, officers, and employees from any claims, damages, or expenses arising from:

Your use or misuse of the Services;
Violation of this Agreement;
Infringement of third-party rights.

Suspension or Termination

We may suspend, restrict, or close your account without prior notice if:

We suspect fraud, misuse, or breach of these terms;
Required by law or a competent authority;
You request account closure.

Upon termination, you remain liable for all outstanding obligations.

Data Privacy

Your personal information is handled according to our Privacy Policy. By using Owego, you consent to our data-collection and processing practices as described therein.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Federal Republic of Nigeria. Any dispute shall first be resolved amicably within 30 days of notice. If unresolved, disputes will be referred to arbitration in Lagos, in accordance with the Arbitration and Mediation Act 2023.

Changes To This Agreement

We may update this Agreement periodically. Continued use of the Services after updates constitutes your acceptance of the revised terms.

User Acknowledgement

By using or accessing the Owego platform, website, or any related services, you confirm that you have read, understood, and agreed to be bound by both Owego’s Terms of Use and Privacy Policy, including all updates and amendments. You also acknowledge that continued use of the platform constitutes ongoing acceptance of these terms and that it is your responsibility to review them periodically.
